Terms and conditions
1. This prize draw (the “Prize Draw”) is open to residents of the UK aged 18 and over who possess a valid passport.
2. The Prize Draw is not open to employees or agencies of Guardian News & Media Limited (“GNM”) and Wyndham Vacation Rentals (trading as Guardian Cottages&Villas), their group companies, their family members or anyone else connected with the Prize Draw.
3. Entrants into the Prize Draw shall be deemed to have accepted these Terms and Conditions.
Entry into the Prize Draw
4. To enter the Prize Draw you must sign up to receive travel offer emails from the Guardian by completing the entry form above and press the “Enter now” button to submit your entry. No purchase necessary. If you have any questions about how to enter or otherwise in connection with the Prize Draw, please send an e-mail to: holidayoffers@guardian.co.uk with “Cottage Competition” in the subject line.
5. Only one entry is permitted per person.
6. Entries on behalf of another person will not be accepted and joint submissions are not allowed. You are responsible for the cost (if any) of sending your Prize Draw entry to us.
7. GNM accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by GNM.
8. The Prize Draw opens at 10.00 on Saturday 26th December 2015 and closes at 10.00 on Wednesday 11th January 2016. Entries received outside this time period will not be considered.
Picking the Winner
9. One winner will be chosen from a random draw of all eligible entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process before Monday 18th January 2016.
The Prize
10. Subject always to paragraphs 11 to 15 of these Terms and Conditions, three winners will win a total of £350 each to use towards a cottage stay. The cottage can be selected from www.guardiancottages.co.uk – a selection of 14 000 properties throughout the UK, Ireland, France and Italy. The winners are allowed to bring travel companions should they wish, but any price exceeding £350 will need to be paid for by the winners.
11. The winners must book their stay and travel before 31st December 2016. The prize is subject to availability and subject to acceptance of Wyndham Vacation Rentals booking conditions which can be viewed here: http://www.guardiancottages.co.uk/termsofuse.
12. GNM accepts no responsibility for any costs associated with the prize and not specifically included in the prize including, without limitation: airport transfers, spending money, meals, travel insurance, immunisations and visas.
13. The winner must have booked the prize with Wyndham Vacation rentals by no later than 31st December 2016 otherwise the prize shall be forfeited. It is the responsibility of the winner and their selected travel companion to ensure that (i) they can accept the prize as set out in and in accordance with these Terms and Conditions; and (ii) they obtain and/or possess a valid passport, travel insurance, immunisations and any visas which may be required.
14. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes and cannot be used in conjunction with any other special offers or discounts.
15. GNM retains the right to substitute the prize with another prize of equal or greater value in the event the original prize offered is not available.
Notifying the Winner
16. The winner will be notified by e-mail by GNM on or before Friday 22nd January 2016 and be given details of how to claim the prize. If the winner does not respond to that e-mail from GNM within 28 days of being notified by GNM, then that winner’s prize will be forfeited and GNM shall be entitled to select another winner in accordance with the process described above (and that winner will have to respond to GNM within 28 days of that e-mail being sent to them or else they will also forfeit their prize). If the winner rejects the prize, then the winner’s prize will be forfeited and GNM shall be entitled to select another winner.
Some other rules
17. The name and country of the winner can be obtained after 31st March 2016 by sending a stamped addressed envelope to the following address: The Guardian Marketing Department, Kings Place, 90 York Way, London, N1 9GU.
18. The winner may be required to take part in promotional activity related to the Prize Draw and the winner shall participate in such activity on the Promoter’s reasonable request. The consents to the use by GNM and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner’s voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by GNM and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.
19. GNM shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen at http://www.theguardian.com/help/privacy-policy and in accordance with data protection legislation. By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Prize Draw entry, and for the purposes outlined in paragraph 17 above.
20. GNM and Wyndham Vacation Rentals accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Prize Draw or accepting and taking up the prize. GNM and Wyndham Vacation Rentals further disclaim liability for any injury or damage to you or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw. Nothing in these Terms and Conditions shall exclude the liability of GNM or Wyndham Vacation Rentals for death, personal injury, fraud or fraudulent misrepresentation as a result of their negligence.
21. GNM reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of GNM in all matters relating to this Prize Draw is final and no correspondence will be entered into.
22. GNM shall not be liable for any failure to comply with its obligations relating to this Prize Draw where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
23. The Prize Draw and these Terms and Conditions will be governed by English law and entrants to the Prize Draw submit to the non-exclusive jurisdiction of the English courts.
